POWER OF ATTORNEY

INTRODUCTION

A Power of Attorney is a Legal document where you can give the power to someone to act on your behalf on a variety of Legal matters.

EXAMPLES

These can include the following :-

(a) House Sales and Purchases where the person will not be available for
some time to sign the necessary Legal documents.
(b) Where somebody does not want the bother and hassle of dealing with
their own affairs, perhaps if they are ill or unwell.
(c) Handling financial matters such as Bank or Building Society Accounts,
Stocks or Shares.
(d) Where somebody is going abroad for sometime and needs matters 
dealing with in their absence.

DOCUMENT

A Power of Attorney can be prepared by using a prescribed form, which we can prepare for you. This can be sorted out quickly and easily.

SCOPE OF AUTHORITY

You can either give your Attorney general authority to act on your behalf or you may wish to place limitations or restrictions on the extent of authority. The choice is yours.

CHOICE OF ATTORNEY

You can choose whoever you like to act as your Attorney although often it is best to appoint more than one person, usually a relative, friend or even your Solicitor. By appointing more than one person you can ensure that the Attorney’s powers will not be abused.

ATTORNEY DUTIES

An Attorney has a number of responsibilities, but mainly to act on your behalf and in your best interests. Further information can be provided by us.

A power of Attorney document should not be confused with an Enduring Power of Attorney document, which is different. A Power of Attorney document is effective only whilst you are capable of managing your own affairs. An Enduring Power of Attorney document does not come into effect until you become incapable of managing your own affairs.

You should consider making an Enduring Power of Attorney document at the same time as a general Power of Attorney, particularly if you are thinking of giving somebody the power to deal with matters on your behalf for some considerable time.

REVOCATION

Power of Attorney documents can usually be revoked by you at any time and will automatically become revoked in the event that you become mentally incapable. Sometimes however the Power of Attorney document can be expressed to irrevocable.

LOW COSTS

The costs of making a Power of Attorney are relatively small. The normal charge is £50 inclusive of VAT. Legal Aid may be available.
